Course overview
This agreement applies to the 6‑month online evening batch Digital Marketing Course delivered via live virtual classes, recordings, assignments, and a learning portal, scheduled on weekdays between 6:30 PM and 9:30 PM IST unless otherwise notified.
A certificate of completion may be issued upon satisfying the stated requirements, and it is expressly clarified that this is not a university “degree” or equivalent under Section 22 of the UGC Act, 1956.
Eligibility and enrollment
Enrollment is offered on a first‑come basis to individuals meeting the minimum prerequisites (e.g., device, internet access, and functional English), and providing accurate identity and contact details.
The provider may reject or cancel enrollment for misrepresentation, non‑payment, or policy violations, with any refunds handled per the Refunds section below.
Fees and payments
Total fees, taxes, available installment plans, due dates, and accepted payment methods are disclosed at checkout and on the order confirmation, with electronic records and e‑contracts valid under the Information Technology Act, 2000.
Late payments may attract penalties, temporary access suspension, or batch transfer denial, and reinstatement occurs after dues are cleared.
Refunds and cancellations
Transparent return/refund terms are displayed prior to purchase and in confirmations, consistent with the Consumer Protection (E‑Commerce) Rules, 2020.
Unless mandated otherwise by applicable law, a defined cooling‑off window (e.g., up to 7 days before cohort start) permits a refund less administrative charges; after the first session, refunds are typically not available, except for documented service deficiencies or statutory rights.
Batch transfer and deferment
One batch transfer or deferment may be permitted before week 4, subject to seat availability, fee differences, and an administrative charge.
Deferments beyond the program’s next available cohort may require re‑enrollment at prevailing fees.
Schedule and attendance
The course targets evening sessions on designated weekdays; reasonable changes may be made with prior notice and recordings provided where feasible.
Minimum participation (e.g., 75% live attendance and timely assignment submission) is recommended or required for eligibility toward completion and assessments.
Assessments and certification
Assessments may include quizzes, projects, and presentations, with criteria and rubrics disclosed in advance, and limited retakes or resubmissions at the provider’s discretion.
Successful completion results in a certificate of completion only; no claims of guaranteed marks, admissions, or placements are made, in line with ASCI advertising guidelines for education.
No placement guarantee
Career support (e.g., resume reviews, interview practice, job leads) may be offered as guidance only and does not guarantee internships, jobs, or salary outcomes, consistent with ASCI requirements for substantiation and disclaimers in educational promotions.
Any placement‑related performance data used in marketing must be from the latest completed batch, substantiated, and include “past performance is not a guarantee of future results” type disclaimers per ASCI guidance.
Code of conduct
Learners must maintain professional conduct in live classes, forums, and groups, avoiding harassment, discrimination, unauthorized recording, or disruptive behavior.
Academic integrity is mandatory; plagiarism, cheating, or unauthorized collaboration may result in assessment failure, suspension, or termination without refund.
Intellectual property
All course content (videos, slides, notes, assignments, code, and recordings) is protected by the Copyright Act, 1957, and provided under a limited, personal, non‑transferable license for study during the course and any stated access window.
Copying, sharing, recording, reselling, or public communication of content without written permission is prohibited, and violations may lead to access termination and legal remedies.
Class recordings and publicity
Live classes may be recorded for quality, compliance, and academic review; by participating, learners consent to being recorded where applicable and permitted by law, with recordings used within the program and platform.
Use of a learner’s name, image, or testimonials for marketing requires specific, informed consent, which can be withdrawn per the data privacy clause below.
Data privacy and communications
Personal data is processed for enrollment, delivery, support, certification, compliance, analytics, and communications, based on valid consent that is free, specific, informed, unconditional, and unambiguous, with clear affirmative action as required by the Digital Personal Data Protection Act, 2023.
Notices will describe data types, purposes, rights, grievance contacts, and consent withdrawal mechanisms presented in clear language, with electronic records and consent captured in compliance with DPDP and IT Act e‑contract rules.
Technology requirements
Learners are responsible for meeting minimum technical requirements (stable internet, updated browser, audio/video hardware) and for local device security and backups.
Access issues arising from local network, device, or ISP problems are outside service scope, though reasonable support will be provided.
Changes and availability
The provider may update curriculum modules, tools, mentors, schedules, and platform features to improve learning outcomes, with reasonable notice for material changes.
Temporary service interruptions may occur for maintenance, upgrades, or events beyond control; recordings or make‑up sessions may be offered where feasible.
Force majeure
The provider is not liable for delays or failures caused by events beyond reasonable control (e.g., natural disasters, war, strikes, epidemics, government actions, or widespread outages), consistent with widely recognized force majeure practice in India.
Obligations are suspended for the duration of the event, with performance resumed as soon as reasonably practicable after the event ceases.
Limitation of liability
To the maximum extent permitted by law, total liability for claims arising from the program is limited to the fees actually paid for the current cohort, excluding indirect, incidental, or consequential damages.
Nothing in these terms limits liability where such limitation is prohibited by applicable law.
Governing law and disputes
This agreement is governed by the laws of India, with venue in Kerala, and disputes subject to competent courts in Kottayam unless resolved by the arbitration clause below.
At the provider’s option, disputes may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Kottayam, Kerala, and proceedings conducted in English, recognizing the seat as the juridical home per Indian arbitration jurisprudence.
Grievances and redressal
A grievance officer/contact will be designated and details displayed with response timelines, consistent with E‑Commerce Rules requirements for consumer grievance redressal.
Learners may escalate unresolved issues to statutory forums as permitted by applicable consumer protection laws.
Entire agreement and updates
These terms constitute the entire agreement for the course, superseding prior communications, and updates will be posted with effective dates and reasonable notice for material changes in accordance with transparency expectations for online services.
Continued participation after updates take effect constitutes acceptance of the updated terms, without affecting rights to withdraw consent under the DPDP Act for personal data processing.
Certification disclaimer
The certificate awarded is a private certificate of completion and not a degree or diploma; degrees can be conferred only by entities authorized under Section 22 of the UGC Act, 1956, and no contrary representation is made.
Any mention of affiliations or recognitions will be accurate, current, and substantiated, in line with ASCI’s educational advertising guidelines.
